Terry D. Farmer

After working in the Trust Department of First National Bank in Albuquerque for one year, Mr. Farmer joined the Firm in 1975 and has become one of the Firm's main litigation attorneys with extensive experience in commercial and governmental litigation including Indian rights, creditors' rights, banking, construction, real estate and products liability. Mr. Farmer's practice involves commercial financing, real estate development and commercial transactions. He is one of our liaisons with the New Mexico Bankers Association and has practiced extensively in all areas of federal and state banking law and commercial financing. He has been the author of and lobbyist for legislation on behalf of the New Mexico Bankers Association. He is also active in NAIOP. He is a past President of the Albuquerque Lawyers Club and a past President of the Young Lawyers Division of the State Bar of New Mexico. Mr. Farmer has also served as Secretary and Director of Rainbow House International, an international adoption agency. In 1994 Mr. Farmer was elected a Fellow, New Mexico Bar Foundation. In 2003, Mr. Farmer was selected to Outstanding Lawyers of America. He is listed in Who's Who in America and Who's Who in American Law. In 2012, Mr. Farmer was selected by his peers for inclusion in Southwest Super Lawyers in the areas of Business Litigation, Business Law and Real Estate Law.

CONTRACTS

Mr. Farmer's contract practice includes representation of individuals and business entities in all aspects of contracting. From the negotiation of the contract terms, to the drafting of the agreements and, if necessary, the litigation of their provisions, Mr. Farmer's practice encompasses the full scope of contract representation. He has been involved in the negotiation, drafting and litigation of all types of commercial contracts, purchase and sale agreements, real estate documents, leases, financing documents and construction contracts.

REAL ESTATE

Mr. Farmer's real estate practice includes representation of buyers, sellers, investors, developers and lenders, both individually and as commercial entities, in the acquisition and sale, financing, development and operation of real properties. A substantial part of Mr. Farmer's practice involves real estate litigation of all types, including boundary issues, real estate acquisition and sale issues, covenant enforcement, title and boundary disputes, commission disputes and ranching matters. His practice includes giving opinions in mortgage loan transactions on behalf of borrowers and out-of-state lenders. His transactional real estate practice includes undeveloped property, commercial developments, residential developments and ranches. Mr. Farmer has also arranged and documented numerous IRC § 1031 exchange transactions. However, his experience is not limited to the role of an attorney in real estate matters because he has also been actively involved as an owner, director, partner and active participant in a variety of real estate business activities.

BUSINESS LAW

Mr. Farmer's practice includes the formation of all types of business entities including corporations, limited liability companies, general partnerships, limited partnerships and joint ventures. A substantial part of his practice is dedicated to assisting small business owners in their day to day and long term activities both in the operational and planning aspects of their business. Mr. Farmer has served on the boards of directors of several for-profit and non-profit organizations and has advised companies concerning their succession planning, business planning and daily operational matters. Mr. Farmer's transactional practice is complemented by his litigation practice, giving him a well rounded basis for his commercial advice.

BANKING/FINANCE

Mr. Farmer's banking and finance practice has throughout his career consisted of representation of lending institutions and other lenders. He has represented numerous banks in their legal matters including compliance, loan documentation, litigation, and business entity formation, organization, operation and planning. He has frequently given opinion letters on behalf of borrowers and lenders. His practice has included lobbying on behalf of the New Mexico Banker's Association and writing Uniform Commercial Code Article 9 legislation. Mr. Farmer has extensive litigation experience on behalf of lending institutions and extensive experience documenting lending transactions.
