The firm has been involved in the landlord-tenant and mobile home park area of law for many years and is an active participant in the Apartment Association of New Mexico. We have represented a number of national and local developers, apartment owners, mobile home park owners and management companies with a full range of services from acquisition of land through construction of the project to assistance of the management companies with restitutions, fair housing complaints and employment problems. We have taught portions of the Certified Apartment Managers (“CAM”) certification course and have been involved in drafting the New Mexico Owner-Resident Relations Act and various revisions of the Act. We appear before the Magistrate, Metropolitan and District Courts on all forms of restitution and unlawful entry and detainer actions and have handled many fair housing complaints, including those based upon familial status and adult communities. We have experience with three-day notices for nonpayment of rent, three-day notices for substantial violations for narcotics, weapons and felonies, seven-day notices for rule violations and thirty-day notices of non-renewal. We also work with a number of associated businesses in the areas of tenant screening, tenant locator services and grounds maintenance.
We also represent a number of homeowners associations with a wide range of services related to drafting, revision and enforcement of restrictive covenants, formation and conduct of owners’ associations and architectural control committees and resolution of neighborhood disputes ranging from nonpayment of assessments to enforcement of building restrictions and enforcement of water use restrictions.
