Personal Injury

Lawyers who practice in this area are:
Mark A. Glenn and Jocelyn R. Castillo.

Unfortunately, people are hurt every day in accidents on New Mexico’s roads and highways. We have represented injured people on a variety of personal injury claims, many of them involving motor vehicles. If applicable, injured persons are entitled to recover medical expenses, lost wages, pain and suffering, and other damages that are attributable to their injuries. Injured parties may be entitled to recover punitive damages if they can demonstrate the negligent party acted intentionally or willfully. These claims generally involve negotiation with the insurance company or companies that have insured the driver who caused the accident. If negotiating with the insurance company is not successful, a lawsuit against the negligent driver and/or owner of the other car is necessary. Generally, we represent injured people on a contingency fee basis. In return for representation, clients agree, in writing, to pay a percentage (generally, one-third) of the gross amount recovered through settlement or litigation. In addition, clients are responsible for paying all costs, including but not limited to copies of medical records, bills and reports, deposition fees, witness fees, filing fees, service of process fees and expert witness fees, including accident reconstruct experts and medical experts. The client will bear all expenses incurred regardless of the outcome.

Our personal injury experience includes:
A woman who was seriously injured when she was run over by a car in the darkened parking lot of a public school.

A man who was injured when his minivan was knocked on its side when hit by a woman who ran a red light at an Albuquerque intersection.

A man injured when his rental car was struck at a Santa Fe intersection by a hit-and-run driver.

A Canadian resident who was seriously injured when she was thrown from an overturned truck driven by a drunken driver who had no insurance. This claim was pursued against the injured woman’s own uninsured automobile insurance coverage.

A woman who suffered dental injuries when she bit into food items purchased from a restaurant chain.

A woman who was injured when she slipped and fell at an area shopping mall.
